Action for death by wrongful act brought in the Clay County District Court by Raymond L. Shumway as trustee for the heirs of Lorraine Elizabeth Shumway Adsero whose death resulted when the automobile in which she was a passenger collided with a bridge abutment. The automobile was operated by her husband, Marshall K. Adsero, who also died as a result of the accident. E. O. Nelson, special administrator of the estate of said husband, was named as defendant and he appealed from an order, Rol E. Barron, Judge, denying his motion for judgment on the pleadings or summary judgment, which order certified the question presented to be important and doubtful.
